This policy explains how warranties apply to products supplied by Aussie Golf Sims Pty Ltd ("Aussie Golf Sims", "we", "our" or "us"), how warranty and product issues are handled, and how voluntary manufacturer or product warranties interact with your rights under the Australian Consumer Law.
Some products we sell include a voluntary warranty provided by Aussie Golf Sims, the product manufacturer or another supplier. The duration and conditions of these warranties vary between products.
A voluntary warranty is additional to, and does not replace or limit, any rights or remedies you may have under the Australian Consumer Law.
1. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
These rights apply automatically where the Australian Consumer Law applies and are separate from any voluntary manufacturer or product warranty.
Depending on the circumstances, consumer guarantees may include requirements that goods:
- are of acceptable quality;
- are reasonably durable;
- are safe and free from defects;
- are fit for their normal purpose;
- are fit for a particular purpose that you made known to us before purchase, where you reasonably relied on our skill or judgement;
- match their description, sample or demonstration model; and
- comply with applicable express warranties or representations made about them.
There is no single fixed period for how long Australian Consumer Law rights apply. The relevant period depends on factors including the nature and price of the product, how it would reasonably be expected to be used, representations made about it and its expected durability.
This means that Australian Consumer Law rights may continue after a stated manufacturer or voluntary warranty period has expired.
2. Voluntary Product Warranties
Some products sold by Aussie Golf Sims may include an additional voluntary warranty.
Where a specific warranty period is advertised for a product, the applicable warranty period and conditions will be those stated for that product and in any warranty documentation supplied with it.
Depending on the product, the warranty may be provided by:
- Aussie Golf Sims Pty Ltd;
- the product manufacturer;
- the Australian distributor or importer; or
- another identified warranty provider.
Warranty periods and conditions can vary significantly between different products, manufacturers and models. You should therefore refer to the relevant product listing and warranty documentation rather than assuming that the same warranty period applies to all products sold by Aussie Golf Sims.
Unless we expressly state otherwise for a particular product, Aussie Golf Sims does not provide a separate fixed-period voluntary warranty in addition to any applicable manufacturer warranty and your rights under the Australian Consumer Law.
3. Aussie Golf Sims Branded Products
Some products carrying the Aussie Golf Sims or AGS brand may be supplied with a specific voluntary warranty against defects.
Where we advertise a specific warranty period for an AGS-branded product, the warranty documentation supplied with that product will specify:
- the duration of the voluntary warranty;
- the defects or issues covered by the warranty;
- any reasonable conditions applying to the warranty;
- how to make a warranty claim;
- who is responsible for expenses associated with making a claim; and
- the remedy available where a valid warranty claim is established.
Any AGS voluntary warranty operates in addition to rights available under the Australian Consumer Law.
The expiry of an AGS voluntary warranty does not automatically mean that you no longer have rights in relation to the product.
4. Impact Screens and Other Wear Items
Golf simulator impact screens and some other simulator components are subject to repeated physical impact and will naturally wear over time.
The lifespan of an impact screen can vary substantially depending on factors including:
- frequency and intensity of use;
- ball speed;
- commercial versus residential use;
- screen tension and installation;
- the condition and cleanliness of golf balls;
- the condition and cleanliness of golf clubs;
- where balls repeatedly strike the screen; and
- maintenance and environmental conditions.
Where an AGS impact screen is sold with a stated voluntary warranty period, that warranty applies in accordance with the specific warranty terms supplied with the screen.
Ordinary deterioration arising from normal use is different from a defect in materials or manufacture. Similarly, damage caused by misuse, incorrect installation or external factors may not be covered by a voluntary warranty where the applicable warranty terms exclude that damage.
However, the existence of wear, use or the expiry of a stated warranty period does not by itself remove any rights you may have under the Australian Consumer Law. Any claim will be considered having regard to the particular circumstances and the cause of the problem.
5. Manufacturer Warranties
Many third-party products sold by Aussie Golf Sims, including launch monitors, projectors, computers and other electronic equipment, may include a manufacturer's voluntary warranty.
The manufacturer may specify its own:
- warranty duration;
- registration requirements;
- warranty exclusions;
- repair procedures;
- authorised service centres; and
- claim process.
Where we advertise a manufacturer's warranty period, the warranty is subject to the terms issued by that manufacturer unless we expressly state that Aussie Golf Sims itself is providing the warranty.
Manufacturer warranty terms may also differ depending on the product, model and whether the equipment is being used in a residential or commercial environment.
A manufacturer's warranty operates separately from your Australian Consumer Law rights.
If you purchased the product from Aussie Golf Sims, you may contact us regarding a product problem even where a manufacturer warranty also applies. We will not require you to deal exclusively with the manufacturer where Australian law gives you a right to seek a remedy from us as the retailer.
6. Commercial Use
Some golf simulator products are designed or suitable for both residential and commercial use. Other products may have manufacturer warranty conditions that differ where equipment is used commercially.
If a manufacturer provides different warranty periods or conditions for commercial use, those conditions will apply to that manufacturer's voluntary warranty.
The terms of a manufacturer's voluntary warranty do not determine whether you have rights under the Australian Consumer Law. Australian Consumer Law rights will apply where the relevant legal requirements are satisfied.
7. What Voluntary Warranties May Not Cover
Subject always to the specific warranty terms applying to the product, a voluntary warranty may not cover a problem to the extent that it was caused or contributed to by:
- accidental or deliberate damage;
- misuse, abuse or use contrary to supplied instructions;
- incorrect assembly or installation;
- unauthorised modification, alteration or repair;
- failure to carry out reasonable maintenance;
- normal wear and tear where wear is not itself the result of a product defect;
- liquid or moisture damage where the product is not designed for such exposure;
- power surges, unsuitable electrical supply or external electrical faults;
- use outside stated operating conditions;
- damage caused by another product or item of equipment;
- software or services supplied by an unrelated third party;
- cosmetic changes that do not affect the normal operation of the product, unless otherwise covered; or
- a defect or condition specifically disclosed to you before purchase.
An exclusion under a voluntary warranty does not automatically remove rights available under the Australian Consumer Law. Whether a consumer guarantee applies will depend on the circumstances and the cause of the problem.
8. Making a Warranty or Product Claim
If you experience a problem with a product purchased from Aussie Golf Sims, contact us at info@aussiegolfsims.com.au.
To assist us in investigating the issue, we may reasonably ask you to provide:
- proof of purchase;
- your order number, where available;
- the product name and model;
- the product serial number, where applicable;
- a description of the problem;
- photographs or video demonstrating the issue where practicable;
- details of how and when the problem occurred; and
- reasonable troubleshooting information relevant to the product.
We may initially attempt reasonable troubleshooting where this may resolve the issue without requiring the product to be returned.
You are not required to have the original packaging in order to exercise rights under the Australian Consumer Law, although retaining appropriate packaging can assist with safely transporting electronic equipment if it needs to be returned.
9. Product Assessment
We may reasonably inspect or arrange an assessment of a product before determining whether a warranty or consumer guarantee remedy applies.
Depending on the product, an assessment may be performed by:
- Aussie Golf Sims;
- the manufacturer;
- the Australian distributor;
- an authorised service centre; or
- another appropriately qualified technician.
For electronic products such as launch monitors, projectors and computers, reasonable troubleshooting or technical assessment may be required to determine whether an issue relates to hardware, software, settings, configuration, third-party services or another cause.
The involvement of a manufacturer or authorised service agent in an assessment does not remove any obligations Aussie Golf Sims may have to you under the Australian Consumer Law.
10. Repairs, Replacements and Refunds
The appropriate remedy will depend on the applicable warranty, the Australian Consumer Law and the nature of the problem.
For a valid voluntary warranty claim, the remedy will be determined in accordance with the terms of the relevant warranty.
Where the Australian Consumer Law applies:
- for a major failure with goods, you may be entitled to choose between a refund or replacement, or keep the product and seek compensation for the reduction in value;
- for a minor failure, we are generally entitled to choose an appropriate remedy, such as repair, replacement or refund, provided the problem is remedied within a reasonable time; and
- other reasonably foreseeable loss or damage may also be recoverable where provided for by law.

11. Warranty Claim Costs
Responsibility for expenses associated with a voluntary warranty claim will be determined by the terms of the relevant warranty.
Where a product fails to comply with a consumer guarantee under the Australian Consumer Law, responsibility for reasonable return, collection or transport costs will be determined in accordance with the Australian Consumer Law and our Returns & Refunds Policy.
Where a product can reasonably be posted or returned, we may ask you to return it for assessment. If the product is confirmed to have a problem for which we are responsible under the Australian Consumer Law, reasonable return costs will be reimbursed where required by law.
For large, heavy, installed or otherwise difficult-to-return goods, we will arrange or pay reasonable collection costs where required by law.
If a product is assessed and found not to have the reported problem, or the issue was caused by something for which we are not responsible, reasonable assessment or transport costs may be payable by you where permitted by law. Where we intend to charge such costs, we will provide a reasonable estimate before arranging the relevant assessment or collection.
12. Software, Apps and Third-Party Services
Some products require or interact with third-party software, applications, licences, subscriptions, cloud services or online platforms.
These services may be provided by a separate company and may be governed by that provider's own terms, subscriptions and warranty arrangements.
Third-party providers may change software functionality, compatibility requirements, pricing, subscriptions or online services from time to time.
Aussie Golf Sims is not responsible for changes independently made by a third-party provider that are outside our reasonable control, except to the extent that we made a representation about that service or applicable law provides otherwise.
This section does not limit any rights arising from representations made by Aussie Golf Sims regarding the compatibility, functionality or intended use of a product.
13. Replacement and Repaired Products
Where a product or component is repaired or replaced under a voluntary warranty, any warranty applying to the repaired or replacement product will be determined by the terms of the applicable warranty.
Regardless of the terms of a voluntary warranty, repaired and replacement products may also be subject to consumer guarantees under the Australian Consumer Law where applicable.
14. Relationship With Our Returns & Refunds Policy
This Warranty & Consumer Guarantees Policy should be read together with our Returns & Refunds Policy and Terms & Conditions.
If there is an inconsistency between a voluntary warranty and a right or remedy that cannot lawfully be excluded under the Australian Consumer Law, the Australian Consumer Law prevails.
Our voluntary 30-day change-of-mind return policy is separate from warranty and consumer guarantee claims.
