These Terms and Conditions ("Terms") govern your use of the Aussie Golf Sims website, products, and services. By accessing or using our site, or purchasing from us, you agree to these Terms. If you do not agree, please do not use the website. Simulator hire is also subject to our separate Terms & Conditions of Hire, which apply in addition to these Terms for hire bookings.

1. About Us

Aussie Golf Sims Pty Ltd ("Aussie Golf Sims", "we", "our", "us") is an Australian company supplying golf simulator enclosures, impact screens, hitting mats, launch monitors, projectors, simulator PCs, and related products and services to customers in Australia.

2. Use of the Website

You may use our website for lawful purposes only. You must not:

• use the website in any way that breaches any applicable law or regulation;
• attempt to gain unauthorised access to the website, its servers, or any connected systems;
• introduce viruses, malware, or other harmful code;
• use any robot, spider, scraper, or other automated means to access, monitor, or copy the website or its content without our prior written consent; or
• impersonate us, our staff, or any other person.

3. Products, Pricing, and Availability

All prices on the website are in Australian dollars (AUD) and include GST unless stated otherwise. We take care to ensure product descriptions, specifications, images, and prices are accurate, but errors can occur. If a product is listed at an incorrect price or with incorrect information, we may cancel the affected order and refund any amount paid before dispatch. Product availability may change without notice, and some products are made to order, which may affect delivery timeframes. Product images are for illustration purposes; minor variations in colour, finish, and appearance may occur between the images shown and the goods supplied, particularly for screens, turf, and fabric products viewed on different displays.

4. Orders, Quotes, and Payment

When you place an order, you are making an offer to purchase, which we may accept or decline (for example, where stock is unavailable or we suspect fraud). Payment is due in full at the time of order unless we agree otherwise in writing. Payments are processed by secure third-party payment providers.

Written quotes we provide (including for commercial and club installations) are valid for 14 days from the date of issue unless the quote states otherwise, and may be withdrawn or revised at any time before you accept them.

Ownership (title) in goods does not pass to you until we have received payment in full for those goods, even though risk in the goods passes to you on delivery. Until title passes, you must store the goods in a way that shows they belong to Aussie Golf Sims Pty Ltd.

5. Custom and Made-to-Order Products

Custom-sized products (such as custom RooBox enclosures and custom impact screens) are made specifically to the dimensions you provide. You are responsible for the accuracy of measurements you supply. Custom and made-to-order products cannot be returned or refunded due to change of mind, and longer turnaround times apply. Nothing in this clause limits your rights under the Australian Consumer Law where a product is faulty or not as described.

6. Shipping and Delivery

Delivery timeframes shown on the website are estimates only. We will make reasonable efforts to dispatch orders promptly, but we are not liable for delays caused by shipping carriers or events outside our reasonable control. Risk in the goods passes to you on delivery. If you select or authorise unattended delivery ("authority to leave"), goods left in accordance with your instructions are at your risk from the time they are left. You are responsible for providing accurate delivery details; redelivery or re-consignment fees caused by incorrect details or failed delivery attempts may be passed on to you at cost. 7. Returns and Refunds

Our returns and refunds process is set out in our Return/Refund Policy, which forms part of these Terms. In summary, we offer a 30-day returns policy for change of mind on eligible items in unused, original condition and packaging; launch monitors must be unopened and unused to be eligible. Change-of-mind returns do not affect your rights under the Australian Consumer Law for faulty goods.

8. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded.

9. Website Content, Guides, and Interactive Tools

Our website includes blog articles, buying guides, FAQs, product documents, and interactive planning tools such as our room plan editor and enclosure dimension calculators. This content and these tools are provided as general information and guidance only. They are not professional building, structural, electrical, or safety advice, and outputs from our interactive tools are estimates based on the inputs you provide.

Before purchasing, building, or installing a golf simulator, you are responsible for verifying all measurements in your own space, ensuring adequate clearance to swing safely, and complying with any applicable building, strata, or safety requirements. Where a project involves structural work, we recommend engaging a qualified tradesperson. To the extent permitted by law, we are not liable for loss arising from reliance on general website content or tool outputs without independent verification.

10. Intellectual Property

All content on this website (including text, articles, guides, images, graphics, logos, product documentation, interactive tools, page designs, and underlying code) is owned by or licensed to Aussie Golf Sims Pty Ltd and is protected by copyright and other intellectual property laws, regardless of the tools or methods used in its production.

You may view and print content from the website for your own personal, non-commercial use. You must not, without our prior written consent:

• reproduce, republish, or distribute our content, in whole or in substantial part, on any other website, marketplace listing, or publication;
• use our content, images, or product descriptions to market or sell competing products;
• copy, adapt, or reverse-engineer our interactive tools; or

11. Product Use and Safety

Golf simulators involve swinging clubs and striking balls at speed. You are responsible for setting up and using our products safely and in accordance with the instructions provided, including maintaining adequate clearance, using clean balls and clubs with impact screens, and supervising children. To the extent permitted by law, we are not liable for injury or property damage arising from misuse of products, failure to follow instructions, or use in an unsuitable space.

12. Third-Party Products, Software, and Links

Some products we sell (such as launch monitors, projectors, and PCs) are manufactured by third parties and may come with their own manufacturer warranties, terms, apps, or software subscriptions (for example, golf simulation software licences). Those third-party terms are between you and the relevant provider. Our website may also contain links to third-party websites; we are not responsible for their content or privacy practices.

13. Reviews and Customer Content

If you submit a review, rating, photo, video, or other content to us or through our website or social channels, you grant Aussie Golf Sims Pty Ltd a non-exclusive, royalty-free, perpetual licence to use, reproduce, and display that content on our website and in our marketing, typically attributed to your first name only. You confirm any content you submit is your own, is accurate and based on genuine experience, and does not infringe anyone else's rights. 14. Limitation of Liability

To the extent permitted by law, and subject always to the Australian Consumer Law:

• we exclude all liability for indirect or consequential loss, loss of profits, or loss of data arising from your use of the website or our content and tools; and
• our total liability in connection with goods or services we supply is limited, at our election, to the resupply of the goods or services or the payment of the cost of resupply.

15. Force Majeure

We are not liable for any delay or failure to perform our obligations (other than an obligation to pay money) caused by events beyond our reasonable control, including natural disasters, fire, flood, epidemics, industrial action, freight and shipping disruptions, supplier failures, utility outages, and government actions. If such an event continues for more than 60 days, either party may cancel an affected order and we will refund amounts paid for goods not yet dispatched.

16. Privacy

Our collection and handling of personal information is governed by our Privacy Policy, which forms part of these Terms.

17. Changes to These Terms

We may update these Terms from time to time. The current version will always be published on this page with its effective date. Changes apply from the date they are published and do not affect orders already placed.

18. General

If any part of these Terms is found to be invalid or unenforceable, that part will be read down or severed to the minimum extent necessary, and the remainder of these Terms will continue in full force. A failure by us to enforce any right under these Terms is not a waiver of that right. You may not assign your rights under these Terms without our written consent. These Terms, together with our Privacy Policy, Return/Refund Policy, Shipping information, and (for hire bookings) our Terms & Conditions of Hire, form the entire agreement between you and us in relation to your use of the website and purchases from us.

19. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales.
